The State of Florida is known as a “debtor’s paradise” as a result of many laws that protect the assets of a debtor. In order to collect on a judgment, you will need to hire an experienced and qualified attorney. All judgment debtors are required to provide Form 1.977 (Fact Information Sheet) to counsel for the Plaintiff or the Plaintiff within 45 days of entry of the judgment. Most debtors do not comply with this requirement as they are hesitant to disclose their assets, income, bank account information and tax returns. Typically, we commence our collection efforts by using the power of a court order to require the debtor to disclose this information. Based upon our findings, we can next proceed to garnish the wages or bank accounts of the debtor.
